South Korea is set to begin enforcing the AI Basic Act on January 22, 2026, positioning the country to become the first nation to actively implement an AI law, according to a report cited in an online post. The move comes as the European Union, long seen as a leader on AI rules, is described in the same post as moving more slowly on parts of its own AI framework.

The law is identified as the “Framework Act on the Advancement of Artificial Intelligence and the Establishment of a Trust-Based Foundation,” also referred to as the AI Basic Act. The post says industry insiders described South Korea’s start date as earlier than the EU’s timeline for rolling out a substantial portion of its rules for high-risk AI systems.

What enforcement means

The post says South Korea’s enforcement schedule would put it ahead of the EU in terms of real-world timing for implementing AI-related legal obligations. It also frames the January start as a major milestone because it describes South Korea as the first country to actively enforce laws tied to artificial intelligence.

At the same time, the post describes uncertainty around how quickly the EU’s AI rollout will proceed. It points to discussion that the EU’s regulatory push may slow further, though it presents this as speculation rather than a confirmed decision.

EU timeline questions

According to the post, while the EU created an early legal structure for AI, it plans to implement a significant portion of its provisions for high-risk AI systems starting in August next year. The post also says the European Commission introduced a “Digital Simplification Package” last month that included measures aimed at regulatory relaxation.

In that context, the post reports there is speculation the EU’s AI regulation rollout could be delayed until late 2027. It says this possible shift is viewed as a response to pressure from major U.S. tech firms and to concerns within Europe about falling behind in global AI competition.

South Korea’s stance

The post says the South Korean government is taking a cautious approach when reacting to possible changes in the EU’s AI framework. It adds that the government noted amendments to the EU Artificial Intelligence Act would require agreement among EU member states and could face pushback from civic organizations, making the direction of change hard to predict.

The same post also says some industry voices question whether South Korea is moving too fast, especially as the EU is described as leaning toward deregulation. Those critics, as presented in the post, argue that rushing the implementation may be unnecessary under the current international climate.

Startups report low readiness

A survey described in the post, conducted by Startup Alliance with responses from 101 domestic AI startups, found that 98% said they struggled to set up effective systems ahead of the AI Basic Act’s enforcement. The post says the concerns were widespread and that many companies felt unprepared for the new requirements.

It reports that 48.5% of surveyed startups said they do not fully understand the law’s content and are not ready. Another 48.5% said they are aware of the law but believe their response strategies are insufficient, according to the post.

Risks and policy direction cited in the post

In a comment included under the same post, the author links South Korea’s upcoming AI regulation to concerns tied to generative AI, including misuse of deepfake technology for sexual exploitation and political disinformation. The comment also says South Korea introduced earlier regulatory measures in the early 2020s, including election-law updates aimed at addressing AI-generated misinformation during elections and a ban on creating deepfake content intended for sexual exploitation.

The same comment describes South Korea’s broader AI governance approach as combining state-led regulation with industrial policy. It says the country’s strategy focuses on what officials call “physical AI,” described as integrating AI into manufacturing and industrial settings to reduce reliance on human workers, with examples such as robotic welding systems for shipbuilding and smart-factory equipment designed to produce goods with minimal human input.

The comment further says the government largely views generative AI as a productivity tool that needs oversight, and it characterizes the regulatory direction as focusing on reducing societal risks linked to generative AI rather than limiting advanced AI research. It adds that the stated emphasis is on steering AI development toward industrial automation and strengthening manufacturing capabilities.
