South Korea has charged ten former Samsung Electronics employees for allegedly leaking critical semiconductor technology to Chinese chipmaker ChangXin Memory Technologies (CXMT), in one of the most damaging cases of industrial espionage in the country’s history. The stolen technology, which reportedly cost Samsung over 1.6 trillion won to develop, may have handed China the ability to manufacture advanced memory chips years ahead of schedule.
The case has sent shockwaves through South Korea’s semiconductor industry and has drawn attention to a growing pattern of technology theft targeting the country’s most valuable tech assets.
How the Technology Was Stolen
The Seoul Central District Prosecutors’ Office charged ten individuals, including a former Samsung executive and several engineers. Five were taken into custody, while five others were released on bail pending trial. All ten face charges of violating South Korea’s Industrial Technology Protection Act.
The methods used to smuggle out the secrets were unusually low-tech. One former Samsung researcher, identified only as “Mr. B,” manually transcribed 12 pages of detailed DRAM manufacturing information by hand across hundreds of steps. The handwritten notes covered equipment specifications, process sequencing, and yield optimization techniques. Prosecutors say the suspect chose this route deliberately — semiconductor firms heavily monitor digital file transfers and smartphone camera activity, so going analog was a way to avoid triggering alarms.
Another key figure, referred to as “Mr. A,” was a former Samsung executive who reportedly led 10-nanometre DRAM development work at CXMT after leaving Samsung. The group allegedly used shell companies to pass information and regularly changed office locations to avoid detection. Internal communications reportedly assumed that South Korea’s National Intelligence Service could be listening, and the group used cryptography for sensitive messages.
What Was Taken — and What It Enabled
The stolen information centered on Samsung’s 10-nanometre DRAM manufacturing processes. At the time the leaks began, Samsung was the only company in the world that had successfully mass-produced chips using this technology.
According to prosecutors, CXMT used the stolen data — adjusted and validated to fit its own equipment — to achieve production of 10-nanometre DRAM in 2023, making it the first Chinese company to reach that milestone. That breakthrough reportedly laid the groundwork for CXMT to begin volume production of HBM2 memory by 2024. High-bandwidth memory, or HBM, is a critical component in artificial intelligence computing and is in enormous demand globally.
Prosecutors also found that CXMT obtained additional DRAM technology from SK Hynix through a third-party supplier, further accelerating its development. The estimated financial damage to companies like Samsung runs into at least tens of trillions of won, with one report citing a 5 trillion won drop in Samsung’s sales linked to the fallout.
CXMT, which is pursuing a Shanghai stock market listing at a reported valuation of around 42 billion US dollars, recently unveiled its latest generation DDR5 DRAM — directly competing with Samsung and other South Korean chipmakers.
Courts Tighten the Screws
The legal consequences have been significant, and courts are escalating the criminal stakes. A former Samsung section chief, identified as Kim, was originally sentenced to seven years in prison and a fine of 200 million won at trial. A second court reduced that to six years but kept the fine.
South Korea’s Supreme Court then stepped in and overturned parts of the lower court’s ruling, sending the case back for retrial. The Supreme Court ruled that exchanging trade secrets between co-conspirators counts as a separate offense from simply using those secrets — a significant legal clarification. Justices argued that treating the exchange as merely a “means to use the secret” created an unfair loophole: people who tried and failed to use stolen secrets could end up with lighter punishments than those who merely passed them along.
The ruling strengthens protections under the Unfair Competition Prevention Act, which was amended in 2019 to expand punishable conduct beyond employees directly leaking secrets, to include disclosures to third parties and unauthorized exports.
A Wider Pattern of Semiconductor Espionage
This case is far from an isolated incident. South Korea’s National Intelligence Service documented 93 suspected industrial espionage cases between 2018 and 2023, with the semiconductor, display, and battery industries as the primary targets. In 2023 alone, authorities detected 23 such cases.
Earlier incidents include a former SK Hynix employee caught before boarding a flight to China, and a 66-year-old semiconductor expert — with 18 years at Samsung and another decade at SK Hynix — indicted for allegedly stealing manufacturing secrets to build a competing chip factory in China, where he reportedly recruited around 200 engineers from both companies.
Separately, Samsung’s display division settled a years-long legal battle with Chinese firm BOE Technology over OLED patent infringement and trade secret theft in November 2025. A preliminary ruling had found BOE misappropriated Samsung Display’s OLED secrets and had recommended banning the company from exporting OLED panels to the United States for nearly 15 years before the two sides reached an agreement.
South Korea’s Balancing Act
Despite these cases, South Korea must tread carefully. China remains the country’s largest trading partner, and economic ties run deep. Analysts note that Beijing has shown willingness to use trade as leverage, as seen in past export controls on urea. South Korean authorities are now walking a difficult line — protecting their crown-jewel semiconductor technologies while avoiding a diplomatic rupture with their most important economic partner.
South Korea’s parliament passed revised espionage legislation in November 2024, expanding punishable offenses to include spying for countries beyond North Korea — a significant legal gap that had left authorities with limited tools against foreign industrial espionage.
